2. The petitioner is in custody in connection with Bhimpur P.S Case No. 61 of 2023 registered for the offences punishable under Sections 494, 365, 366(A), 376/34 of the I.P.C. and Section 4, POCSO Act.

3. As per prosecution case, As alleged petitioner has kidnapped the daughter of the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that victim stated in her statement under Section 164 and 161 of the Cr.P.C that no forced is used by the petitioner on her and she went from her house in her own will. It is also

It is further submitted that petitioner has no criminal antecedent as stated in para 3 of the bail petition. It is also submitted that petitioner is in judicial custody since 09.06.2023.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, impugned order, case diary , and statement of the victim in 161 and 164 Cr.P.C and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. VI cum Special Judge POCSO Supaul in connection with Bhimpur P.S Case No. 61 of 2023.
