2. The petitioner seeks regular bail in connection with Khutauna P.S. Case No.79 of 2023, G.R. No.505 of 2023, Tr. No.3705 of 2023, lodged under Sections 272 and 273 of the I.P.C. read with section 30(a) of Bihar Prohibition and Excise Act.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 08.11.2023 passed in Cr. Misc. No.59134 of 2023 in which liberty was granted to him to renew his prayer for bail after framing of charge.
4. Learned counsel for the petitioner further submits that the charge has already been framed in this case on
Patna High Court CR. MISC. No.8942 of 2024(3) dt.19-04-2024 2/2 22.12.2023.
5. Learned counsel for the State opposes the prayer for bail and submits that it is true that the charge has already been framed in this case.
6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Jhanjharpur, Madhubani in connection with Khutauna P.S. Case No.79 of 2023, G.R. No.505 of 2023, Tr. No.3705 of 2023 subject to the conditions as laid down under Section 437(3) of Cr.P.C.
7. With this observation, the bail application stands allowed.
