JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-10-2021 This case has been heard out of turn on the request of the learned counsel for the petitioner as almost all the accused persons of this case have been granted anticipatory bail and that this application was filed in the month of October, 2020 and since then it has not been taken up even once.

The petitioner seeks bail in anticipation of her arrest in connection with Baruni P.S. Case No. 02 of 2020, dated 01.01.2020, instituted for the offences under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The nephew of the informant, who was prosecuting his studies had developed love affairs with one Jyoti Kumari, who is the daughter of one Sukhdeo Sah. This was not liked by the relatives of aforesaid Jyoti Kumari. The nephew of the informant was threatened of dire consequences in case he did not remove himself from the village or disassociated himself with aforesaid Jyoti Kumari. Aforesaid Jyoti Kumari has already been married. The dead-body of the deceased could not be recovered.

Hence, the prosecution with suspicion on all the accused persons including the petitioner.

Almost all the accused persons of this case, it has been submitted, have been granted anticipatory bail by different Benches of this Court. The petitioner is only a

Patna High Court CR. MISC. No.18033 of 2021(3) dt.05-10-2021 3/3 neighbour of aforesaid Sukhdeo Sah whose daughter was in the center stage of the entire controversy.

Regard being had to the afore-noted facts, the implication of the petitioner on the basis of suspicion and her gender, she/Girisha Kumari @ Girisha Devi, in the event of her arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/Court concerned, Begusarai in connection with Baruni P.S. Case No. 02 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
