2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 21(b), 22(b) and 29 of the N.D.P.S. Act.
3. The case of the prosecution is that from the possession of this petitioner brown sugar amounting to 10.40 grams was recovered along with some cash.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The recovered contraband which has been recovered from the possession of this petitioner is more than small quantity but less than commercial quantity. A statement has been made in para-3 of this petition that the
Patna High Court CR. MISC. No.8972 of 2025(2) dt.19-03-2025 2/2 petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 14.09.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bahadurganj P.S. Case No. 271 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge (NDPS Act), Kishanganj.
