2. The petitioner seeks regular bail in connection with Sessions Trial No.859/2023 arising out of Maniyari P.S. Case No. 206 of 2023, lodged on 04.07.2023 under Sections 302, 34 of the Indian Penal Code read with section 27 of the Arms Act.
3. As per the prosecution case, FIR has been lodged against one named and other unknown accused persons. The allegation against the present petitioner is that informant's husband was involved in the business of purchase and sale of the land with the accused Bulbul Rai and the father of the accused who is petitioner in this case took the informant's husband with him and later on brought her husband in injured
Patna High Court CR. MISC. No.8422 of 2024(3) dt.03-05-2024 2/3 condition and left him at the main gate of informant's neighbour namely Ajay Kumar and at the time of death of the informant's husband, he whispered about Bulbul Rai.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the petitioner is an old person aged about 72 years and retired from the bank service. Counsel further submits that the petitioner has been made accused at the instance of the police due to the reason that he is the father of the named accused.
5. Learned counsel for the petitioner submits that the criminal antecedent of the petitioner is clean and he is in custody since 20.07.2023. Counsel also submits that charge has already been framed in this case and no purpose shall be solved keeping the petitioner in custody.
6. Learned APP for the State opposes the prayer for bail of the petitioner.
7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-
