1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Murliganj P.S. Case No. 334 of 2020 dated 17.10.2020 registered under Section 366(A) / 34 of the I.P.C.

3. As per the prosecution story on 14.10.2020 the daughter of the informant, aged about 15 years, went outside of her home but she did not return. It has been alleged that the petitioner along with other co-accused persons have kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that the victim girl is the own cousin sister of the petitioner and the petitioner has falsely been implicated in this case along with entire family

Patna High Court CR. MISC. No.7369 of 2025(2) dt.11-02-2025 2/3 members with oblique motive and previous enmity between the parties. Both the parties are close relatives and co-sharers. The informant is the own aunt of the petitioner. He further submits that after three months of the date of occurrence suddenly on 08.01.2021 the victim girl appeared voluntarily before the court and her statement was recorded under Section 164 Cr.P.C. in which she has stated that she was kidnapped by the petitioner and others. He next submits that entire story has been concocted by the informant's side in order to falsely implicate the petitioner in the present case. The Police after investigation found the case untrue against the petitioner and others and submitted final form not sending the petitioner for trial, however, the learned Magistrate has differed with the Police report and has taken cognizance against the petitioner on 04.05.2024. The co-accused persons i.e. family members of the petitioner have been granted anticipatory bail by this court in Cr. Misc. No. 81780 of 2024.

Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are closely related, Police after investigation submitted final form exonerating the petitioner and others and the co-accused persons have been granted anticipatory bail by this court, as such, I am

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Dinesh Mani Tripathi, learned J.M. 1st Class, Madhepura in connection with Murliganj P.S. Case No. 334 of 2020 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
