2. This is the second attempt of the petitioner for grant of bail. Earlier his application was rejected vide order dated 04.08.2023 passed in Cr. Misc. No. 45767 of 2023.

3. The following order was passed on 04.08.2023 in Cr. Misc. No. 45767 of 2023 :- "Heard learned counsel for the petitioner and learned APP for the State.

2. This application has been filed for grant of regular bail arising out of Shikarpur P.S. Case No. 975 of 2022, registered for the offence punishable under Sections 302, 307, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, the petitioner is one of the conspirator who has participated in the killing of the

Patna High Court CR. MISC. No.11391 of 2024(4) dt.28-06-2024 2/2 deceased. During investigation, it has come that the petitioner has provided weapon from which the deceased was killed. The petitioner is in jail since 17.04.2023.

4. Considering the material available against the petitioner, I am not inclined to grant bail to the petitioner.

5. Accordingly, this application is dismissed.

6. If there is delay in trial, the petitioner may renew his prayer for bail."

4. No ground for review is made out even though some accused have been granted bail. This application is dismissed.
