JUSTICE SUDHIR SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 22.12.2014 in connection with Bathnaha P.S. Case No. 337 of 2014 for the offences instituted under Sections 302/34 of the IPC and 27 of the Arms Act.
The prosecution story, in brief, is that the petitioner alongwith other co-accused persons committed the murder of the son of the informant, namely, Dharmendra Yadav after taking him on Motorcycle for transaction of money regarding land. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 22.12.2014 and the charge sheet has been submitted
Patna High Court Cr.Misc. No.40804 of 2015 (3) dt.14-10-2015 2/2 in the case. There is no allegation of tampering with the evidence against the petitioner. The petitioner has been made accused in the present case on the basis of suspicion. There is no direct or indirect evidence against the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Bathnaha P.S. Case No. 337 of 2014/ G.R. No. 4187/2014.
