The petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 578 of 2018 registered for the offence punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 783 litres of illicit liquor from the box of the Pick-Up van which is said to have been driven by the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he has got nothing to do with the alleged recovered illicit liquor inasmuch as he is only the driver of the said vehicle and the recovery has been made from the box, hence the same might

Patna High Court Cr.Misc. No.7005 of 2019(2) dt.06-02-2019 2/2 have been kept by the owner of the vehicle or the loader of the vehicle. It is submitted that the petitioner has a clean antecedent and he is languishing in custody since 29.12.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned IInd Additional Session Judge-cumSpecial Judge, Bhagalpur in connection with Jagdishpur P.S. Case No. 578 of 2018.
