JUSTICE SUDHIR SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 11.04.2015 in connection with Tedhagachh P.S. Case No. 31 of 2015 for the offences instituted under Section 409 of the IPC. The prosecution story, in brief, is that the Panchayat Sachiv did not account for Old Age Pension amount of Rs. 19,54,400/-. Further the petitioner withdrew huge amount in respect with culvert projects but did not even start work. The petitioner is said to have defalcated above Rs. 31 Lacs of Government money.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.04.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering

Patna High Court Cr.Misc. No.42275 of 2015 (3) dt.15-10-2015 2/2 with the evidence against the petitioner. It is further submitted that the petitioner is ready to deposit an amount of Rs. 1,50,000/- in the learned court below which shall be subject to final disposal of the case.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs. 1,50,000/- in the learned court below which shall be subject to final disposal of the case and on doing so, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.
