The petitioner seeks bail in anticipation of his arrest in connection with Nanpur P.S. Case No. 219/2016 dated 28.08.2016 instituted for the offence under Section 395 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he has been named in the F.I.R. by an arrested co-accused person who in fact was arrested on the statement of a spy.
Learned counsel for the petitioner has submitted that but for the aforesaid confessional
Patna High Court Cr.Misc. No.8148 of 2019(2) dt.13-02-2019 2/2 statement of a co-accused who now has been granted bail, there is no other material to connect the petitioner with the aforesaid offence. There is no recovery from the petitioner and he claims himself to be a student. Regard being had to the aforesaid facts and taking into account the criminal antecedent of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri Sitamarhi in connection with Nanpur P.S. Case No. 219/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
