JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 29-012014 and earlier, his prayer for bail was rejected by this court vide order dated 12-01-2015 passed in Cr. Misc. No. 26740 of 2014 and other analogous cases but the trial court has reported that uptill now, only one prosecution witness could be examined. It has also been reported that the last prosecution witness was examined on 03-09-2014 and after that, no prosecution witness turned up. The petitioner does not have any criminal antecedent and is languishing in jail custody since long without any substantive progress in his trial.

Patna High Court Cr.Misc. No.40685 of 2015 (3) dt.16-12-2015 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dumariyaghat P.S.
