2. The petitioner has moved the Court seeking implementation of the order dated 28.01.2016 passed by the District Teachers Employment Appellate Authority, Nalanda in Review Petition arising out of Appeal No. 6 of 2012, by which there is a direction to pay salary to the petitioner.
3. Today, supplementary counter affidavit has been filed on behalf of the respondent no. 2, in which it has been stated that
Patna High Court CWJC No.11965 of 2016 dt.10-04-2017 2/2 against the order dated 28.01.2016, an appeal has been filed before the State Tribunal on 30.03.2017.
4. In view of the aforesaid, in the considered opinion of the Court, the order dated 28.01.2016, having been assailed by the State authorities in appeal before the State Tribunal, no further order can be passed in the present proceeding.
5. Accordingly, the writ petition stands disposed off with liberty to the petitioner to contest the appeal filed by the authorities before the State Tribunal.
