JUSTICE ARUN KUMAR JHA ORAL ORDER 11-02-2025 Learned counsel for the petitioners submits that the instant application has been filed for setting aside the order dated 17.06.2017 passed by the learned Sub Judge IV, Darbhanga in Title Suit No. 100 of 2016 whereby and whereunder the learned trial court rejected the petition filed by the defendants petitioner under Order 7 Rule 11(d) of the Code of Civil Procedure.

2. Learned counsel for the petitioners submits that against such order a civil revision would lie under Section 115 of the Code of Civil Procedure and seeks permission to convert the present petition into civil revision.

3. Permission is accorded.

4. Learned counsel for the petitioners is directed to

Patna High Court C.Misc. No.1512 of 2017(3) dt.11-02-2025 2/2 convert the instant civil miscellaneous petition into civil revision petition within two weeks.
