The petitioner seeks bail in a case registered for the offence punishable under Section 376 (2)(G) of the Indian Penal Code.

The petitioner and other accused persons are alleged to have committed gang rape with the victim.

It is submitted that the victim herself is a lady of easy virtue. The petitioner has falsely been implicated in the case. Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.

The trial court has begun and the trial court is directed to expedite the trial and conclude the same holding the trial on

Patna High Court Cr.Misc. No.40556 of 2015 (2) dt.03-09-2015 2/2 day-to-day basis within nine months from the date of receipt of this order, if the trial is not concluded within nine months, the petitioner may renew his prayer for bail firstly before the court below.
