The appellants seek anticipatory bail in connection with A.B.P. No. 39 of 2019 (SC/ST Case No. 68 of 2018) arising out of Barbigha P.S.Case No. 121 of 2018 , registered for offences punishable under Sections 147, 148, 341,323, 307, 337, 354 (B) and 504 of the Indian Penal Code and under Section 3(2) (va) (r) ( s) of the SC/ST Act.
The allegation as per the F.I.R. against the appellants is that nephew of the informant threw a piece of wood in the drainage due to that water of drainage fall on Chhote Ram and they have assaulted the informant and others and abused him by calling his caste name.
Patna High Court CR. APP (SJ) No.499 of 2019 dt.29-03-2019 2/2 Learned counsel for the appellants submits that they have not committed any offence and they have no criminal antecedents and no specific allegation has been attributed against any of the appellants and injuries are found to be simple in nature.

Having heard both sides and in view of the facts and circumstances, as stated above, let the appellants, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional District and Sessions Judge, Sheikhpura in connection wih the A.B.P. No. 39 of 2019 in SC/ST Case No. 68 of 2018 arising out of Barbigha P. S.Case No. 121 of 2018, subject to condition as laid down under Section 438 of CR.P.C.
With the aforesaid direction, this appeal is allowed and the impugned order is set aside.
