The petitioner is languishing in jail since 07.06.2015 in a case instituted under Section 387 of the Indian Penal Code. As per allegation, it is a case of Rangdari of Rs.2 lacs demanded through mobile phone by the accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.06.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. The petitioner has been made accused due to mistake of fact. There is no direct allegation against him. It is further submitted that the petitioner may be released after completion of six months in custody from

On behalf of the State, it has been submitted that from perusal of para-98 of the case diary, it would appear that in course of alleged occurrence, the mobile of this petitioner is said to have been used for demanding Rangdari.

Considering the aforesaid facts and circumstances, it is directed that the petitioner be released after completion of six months in custody from 07.06.2015 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction learned CJM, Sheohar in connection with Sheohar P.S.Case No.24 of 2015.
