The petitioner seeks bail in Makhdumpur P.S. Case No.177/2014 registered under Sections 366 (A) and 34 of the Indian Penal Code.

It is alleged that the daughter of the informant had come to her Nanihal at village Chandari and on 2.7.2014 the informant got an information that she had gone to market with her Mami at Makhdumpur from where she was kidnapped by the petitioner along with other co-accused named in the F.I.R. It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He is in custody since 15.04.2015. The charge sheet has been submitted in this case.

Patna High Court Cr.Misc. No.41323 of 2015 (3) dt.30-10-2015 There is no allegation of tampering with the evidence against the petitioner. It is further submitted that the girl has been recovered. From perusal of Annexure-3, it would appear that the victim girl and the petitioner had performed the marriage which was certified by the Prakhand Pramukh. From perusal of Annexure-2, it would further appear that there was a long love affair between the petitioner and the victim girl. Subsequently, the aforesaid facts were denied by the victim girl when she was in the custody of her parents.

On behalf of the State, it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No.177 of 2014.
