The petitioners seek bail in Dhoraiya P.S. Case No. 21/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The petitioners are not named in the FIR. During the course of investigation, the investigating officer collected CDR of the mobile of the deceased. Mobile no. 9955406616 was recovered from the possession of Petitioner No. 1 Ajab Lal Mandal which shows that the petitioner was in contact with the deceased prior to the occurrence. On the basis of such, the police apprehended both the petitioners and took their confessional statement. Call details do not show that the petitioners were present at the place of occurrence or at the place of recovery
Patna High Court Cr.Misc. No.40503 of 2015 (2) dt.02-09-2015 2/2 of the dead body. Save and except the confessional statement of the petitioners the police did not collect any tangible material. Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Dhoraiya P.S. Case No. 21/2015.
