JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 The petitioner seeks regular bail in connection with Gwalpara P.S. Case No. 157 of 2019, registered for offences punishable under Sections 341, 323, 324, 325, 307, 504, 506 and 34 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant on his head by means of spade.

Learned counsel for the petitioner drawing attention of this Court towards Annexure -2 has submitted that the injury caused to the informant on his head was found simple in nature and though one injury was found grievous in nature but that is not on the vital part of the body, as the same is on hand. Further submission is that the occurrence took place due to petty dispute and there was no intention to seriously harm the informant.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Udakishunganj, Madhepura, in connection with Gwalpara P.S. Case No. 157 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
