JUSTICE SUDHIR SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 307 and 379 of the Indian Penal Code and 27 of the Arms Act.
Allegation against the petitioner is that he along with other accused persons fired shots at the informant causing injury to him. It is also alleged that one co-accused took away Rs.5,000/- and mobile phone from the pocket of the informant. It has been submitted on behalf of the petitioner that he is in custody since 4.6.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. From perusal of the injury report it would appear that none of the injuries is on the vital part of the body. Hence, there was no intention to commit murder of the victim. It is further submitted that petitioner may be released after completion of six months in custody from 4.6.2015.
On behalf of the State, it is submitted that the petitioner is

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of six months in custody from 4.6.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Kumar Sudhanshu, learned Judicial Magistrate, West Champaran, Bettiah, in connection with Matiyaria P.S. Case no. 26 of 2012.
