The petitioner seeks bail in a case registered for the offence under Section 413, 34 of the I.P.C. and Section 25(1-b)a, 26, 35 of the Arms Act.

One loaded country-made pistol and one stolen motorcycle have been recovered from the possession of the petitioner.

It is submitted on behalf of petitioner that no incriminating article has been recovered from the possession of the petitioner. The seized motorcycle was not stolen, rather the same belongs to petitioner himself. In support of the submission, Annexure 2 has been brought on record, which is copy of Registration Certificate of the motorcycle and petitioner is in custody since 13.09.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I (West), Muzaffarpur in connection with Kudhni P.S. Case No. 697 of 2021.
