The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
As per allegation, it is a case of murder of informant's son.
It has been submitted of behalf of the petitioner that petitioner has got no criminal antecedent. He is in custody since 24.03.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence against the petitioner. Petitioner has falsely been implicated in the present case. There is no eye-witness to the occurrence except the
Patna High Court Cr.Misc. No.41136 of 2015 (3) dt.29-10-2015 P2/2 informant. There is general and omnibus allegation against the petitioner.
It has been submitted on behalf of the State that petitioner is named in the First Information Report and a specific allegation has been made by the informant in respect to assault made by the petitioner upon the deceased by Lathi. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to this petitioner and the same is accordingly rejected.
Anyhow, the trial Court is directed to expedite the trial and conclude the same preferably within a period of one year from the date of receipt/production of a copy of this order. (Sudhir Singh, J) Saif/- U T
