Case No. 285 of 2019, registered for the offences punishable under Sections 353, 379, 411 of the Indian Penal Code and Section 7 of the E.C. Act.

Petitioner is said to be helper of the driver of the tanker and he along with others allowed the oil to be taken from that tanker and seeing the police party they fled away. Submission of learned counsel for the petitioner is that he is only Khalasi, having no criminal antecedent and he is in custody for more than two months.

Heard learned APP also.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of

Patna High Court CR. MISC. No.5462 of 2020(2) dt.31-01-2020 2/2 the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Naugachia, in connection with Kharik P.S. Case No. 285 of 2019.
