Petitioner seeks bail in S.Tr. No. 148 of 2017 arising out of Fatuha P.S. Case No. 56 of 2016 registered for the offence punishable under Sections 302, 307, 427 and 120 (B) of the Indian Penal Code and under Section 27 of the Arms Act. Informant who is the wife of the deceased has alleged that petitioner along with FIR named accused and 8-10 unknown persons fired upon his husband. It has been further alleged that petitioner and one Babloo Singh dragged out her husband from his vehicle and pulled down him on the ground and thereafter, all accused fired upon him as a result of which he died. The reason for killing is political rivalry and old enmity. It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.12419 of 2019(2) dt.14-03-2019 2/2 he is innocent and has been falsely implicated in this case due to political reasons and previous enmity. He is in custody since 27.10.2016.

Considering direct allegation against petitioner of firing upon the deceased, I am not inclined to enlarge the petitioner on bail at this stage, hence, the prayer for bail of the petitioner is hereby rejected.

However, trial court is directed to expedite and conclude trial expeditiously.
