The petitioner seeks bail in a case registered under Sections 147, 148, 149, 447, 504, 506, 302 of the Indian Penal Code.

Allegation is that accused persons having lathi, danda, garasa, in their hand came and assaulted the husband of the informant, due to which he became unconscious and fell down and later on he died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.06.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused in

Patna High Court CR. MISC. No.6843 of 2019(2) dt.29-04-2019 2/2 the present case merely on the basis of suspicion. Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioner. A suspicion has been raised for simple reason that in the past some altercation had taken place between the deceased and the family members of the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, Rohtas at Sasaram in connection with Chenari P.S. case NO.47 of 2018.
