JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioenr happens to be husband of the deceased whose marriage had taken place with the petitioner eight years ago and after marriage she became mother of three children. The first information report reflects that there was a partition dispute in the family and allegedly, on account of aforesaid dispute, the deceased was administered poison by F.I.R named accused persons including the petitioner. In course of investigation, some witnesses stated that deceased committed suicide by consuming poison.

The contention on behalf of the petitioenr is that the deceased herself consumed poison due to partition dispute and

No.41489 of 2015 (2) dt.15-09-2015 2/2 moreover, she was taken to hospital by the petitioner and after her death her post mortem was done and her dead body was cremated in presence of informant but later on, the informant mounted pressure for money and when the petitioner refused to fulfill the aforesaid demand of informant, then informant lodged the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas (Sasaram) in connection with Kargahar P.S. Case No.32 of 2015.
