JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are in jail custody in a case registered under Sections 25(1-b)a, 26 and 35 of Arms Act. The petitioners are said to have apprehended by the police when they were assembled for preparation of dacoity but according to the prosecution itself, no fire arms were recovered from the possession of the petitioners. Moreover, one co accused, namely, Raju Yadav, having more or less similar allegation has been granted bail by a bench of this Court vide order dated

Patna High Court Cr.Misc. No.42235 of 2015 (2) dt.15-09-2015 2/2 31.08.2015 in Cr. Misc. No. 38267 of 2015.

Accordingly, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur (Ara) in Shahpur P.S.Case No. 168 of 2015.
