JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date: 16-03-2018 Heard learned counsel for the petitioner and State. Admittedly against the impugned order, the petitioner has preferred appeal, which is pending before the Principal Secretary, Department of Education, as is evident from Annexure-19. Learned counsel for the petitioner submits that the appeal is pending since 09.01.2017, but till date there is no decision in one way or the other and under the compelling circumstance, the petitioner has approached this Court.

Instead of keeping the writ application pending, this Court deem it fit and proper to direct the Principal Secretary, Education Department (respondent no.2) to finally decide the appeal

Patna High Court CWJC No.2571 of 2018 dt.16-03-2018 2/2 of the petitioner (Annexure-19), by a reasoned and speaking order within a maximum period of 60 days from the date of receipt/production of a copy of this order.

It is made clear that if the decision of the appellate authority goes against the petitioner, liberty shall be available to the petitioner to agitate before the appropriate forum in accordance with law.

With the aforesaid observations and direction, the writ application stands disposed of.
