The petitioner is in custody in connection with Babubarahi P.S. Case No. 63 of 2018, registered for the offence punishable under Section 302, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that petitioner is living separately from the husband of the deceased. There is no demand of dowry, petitioner is an old man aged about 84 years and he is in custody since 18.4.2018. Considering the fact that petitioner is age about 84 years and he is living separately from the husband of the deceased, the Court is inclined to enlarge the petitioner on bail, let the petitioner named above be released on bail on furnishing
Patna High Court Cr.Misc. No.6828 of 2019(2) dt.06-02-2019 2/2 bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.C.J.M. II, Madhubani, pending in the Court of Additional District Judge VI, Madhubani in connection with Babubarahi P.S. Case No. 63 of 2018, subject to the condition that while releasing the petitioner the Court below shall verify the age of the petitioner and also the fact that petitioner is living separately from his son.
