JUSTICE PURNENDU SINGH ORAL ORDER 20-01-2025 Heard Mr. Sumit Kumar Singh along with Mr. Abhishek Kumar Pandey, learned counsels appearing on behalf of the petitioner and Mr. Vijay Anand, learned counsel appearing on behalf of Economic Offence Unit.
2. Petitioner seeks regular bail in connection with Special (NDPS) Case No.8000077 of 2016, Supplementary Record of Special Case No.20 of 2016 arising out of Economic Offence P.S.Case No.04/2016 (Patna) dated 15.05.2016, registered for the offences punishable under Sections 8/20(b)(ii) (c)/25/29 of N.D.P.S. Act, 1985.
3. Considering the nature of allegation, as well as, the complicity of the petitioner in alleged crime, I am not inclined

4. The Superintendent of Police, Economic Offence Unit, Bihar appears to have shown his negligence in proceeding to get the witnesses examined. He is directed to produce each and every witness(s) on the date fixed for conduct of the trial without fail.
5. The learned Trial court is also directed to expedite the trial in view of the fact that two co-accused persons, namely, Dharmendra Kumar Rajak and Mr. Santosh Kumar Mahto @ Bali Mahto have been convicted and I have found that there are sufficient materials and the evidences before the learned trial court to adjudicate the case in accordance with law.
6. The present bail application is accordingly disposed of.
