The petitioner seeks bail in Katoriya P.S. Case No.15 of 2019 registered for the offence punishable under Section 392 of the Indian Penal Code.

The allegation against the petitioner is of snatching of Rs.78,000/- cash, while he was going to the house with motorcycle and he is an accused in three other cases. Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he is in custody since 20.08.2019. Further submission is that nothing incriminating article has been recovered from the conscious possession of the petitioner nor he has been put on T.I.Parade. The petitioner is not named accused in this case and he has been made accused on the basis of confessional

Be that as it may, considering facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Raushan Kumar, learned Judicial Magistrate, 1st Class, Banka in connection with Katoriya P.S. Case No.15 of 2019 with condition that he has to appear before the local police station of his area for a period of nine months or till the conclusion of the trial, whichever is earlier, so that the police may watch the activities of the petitioner, otherwise the bail bond of the petitioner shall be cancelled.

Let a copy of this order be communicated to the Superintendent of Police, Banka for the needful. With the above observation, this application is allowed.
