JUSTICE SUDHIR SINGH ORAL ORDER 3 29-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 364/379/34 of the Indian Penal Code. As per allegation, four unknown criminals after kidnapping informant's brother, his driver and Khalashi looted the truck along with loaded articles.

It has been submitted of behalf of the petitioner that the petitioner has got no criminal antecedent. He is in custody since 23.06.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence against the petitioner. Petitioner is not named in the First Information Report. The name of the petitioner has come on the basis of a confessional

Patna High Court Cr.Misc. No.41178 of 2015 (3) dt.29-10-2015 statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. Petitioner has not been put on Test Identification Parade. The other co-accused have been granted bail vide Cr. Misc. No. 52555 of 2007, 14690 of 2008 and Cr. Misc. No. 6157 of 2008 after completing one year in custody.

It has been submitted on behalf of the State that petitioner name has come in course of investigation.

Considering the aforesaid facts, it is directed that the petitioner shall be released after completion of one year from the date of custody on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Barh, Patna in connection with Bakhtiarpur P.S.
