2. The present writ petition has been filed by the petitioner challenging the appointment of the petitioner on the post of "Anganwari Sevika" passed by the District Programme Officer issued vide Memo No. 1213 dated 02.08.2019 annexed as Annexure-1.
3. Learned counsel for the State submits that the said writ petition is not maintainable as according to the rule, the order passed by the District Programme Officer is appealable
Patna High Court CWJC No.2917 of 2020(2) dt.02-12-2023 2/2 before the Appellate Authority, but without challenging the same before Appellate Authority, the petitioner has moved before this Court.
4. In this facts and circumstances, counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to avail his remedy before the Appellate forum.
5. Permission granted.
6. Hence, this writ petition is hereby dismissed as withdrawn with the aforesaid liberty.
