The petitioners seek bail in anticipation of their arrest in connection with Samastipur (Muffasil) P.S. Case No. 585 of 2019, dated 23.11.2019, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioners have clean antecedents.

It has been urged on behalf of the petitioners that

Patna High Court CR. MISC. No.7629 of 2020(2) dt.10-06-2020 2/2 recovery of six litres of liquor was made from the possession of one Mohit Sah, who has named the petitioners. The reason for the aforesaid Mohit Sah naming the petitioners is that there is a longstanding dispute with respect to a road in between their houses.

Considering the aforestated facts, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-Cum-Special Judge (Excise), Samastipur in connection with Samastipur (Muffasil) P.S. Case No. 585 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
