While deceased Niraj Kumar @ Rinku Yadav was in a way to Madhepur, was intercepted by the accused persons including these petitioners who being variously armed, began to assault with their respective weapons. During midst thereof, on an order of Ram Bihari Yadav, Bhim and Arjun respectively fired causing injury upon the person of Niraj Kumar @ Rinku Yadav. Then thereafter, it has also been alleged that Ram Chandar Yadav, Pappu Yadav, Ramashish Yadav and Doma Yadav & others also assaulted with Farsa, Axe, Knife over different parts of the body of deceased who was taken to hospital and therefrom, he was referred to DMCH and in the way to DMCH, he succumbed to his
Patna High Court Cr.Misc. No.44666 of 2014 (3) dt.25-03-2015 injuries.
It is apparent that on similar fact and circumstances of the case, bail petition of other co-accused is found to be rejected vide Cr. Misc. No. 36109/2014.
