JUSTICE SATYAVRAT VERMA ORAL ORDER 16-03-2023 Heard learned counsel for the petitioner, learned counsel for the State and learned Senior Counsel for the Board. The present writ application has been filed seeking a direction upon the Collector, Araria and S.D.O, Forbesganj restraining the private respondents from misutilizing the donation money collected in the name of Bara Shivalaya, Fobesganj as they are anti-social elements.

The learned counsel for the petitioner submits that he

Patna High Court CWJC No.11590 of 2017(2) dt.16-03-2023 2/3 is Pujari of the aforesaid temple and is recognized by the Bihar State Board of Religious Trust. It is next submitted that petitioner had represented before the Collector, Araria and the S.D.O., Forbesganj against the misdeeds of private respondents but no steps were taken. It is next submitted that by Annexure-6, the petitioner had also represented before the Board but then also no action was taken.

Learned Senior counsel appearing for the Board submits that in pursuance of the complaint filed by the petitioner, the matter was referred by the Board to the Collector, Araria. It is next submitted that in the event, if the petitioner files a fresh representation before the President of the Board, effective measures would be adopted for tackling the grievances of the petitioner. It is further submitted that even the Board recognizes the petitioner as Pujari of the temple. Learned Senior counsel submits that the Board has also taken steps for constituting a Committee under Section 32 of the Bihar Hindu Religious Trusts Act.

In view of the submissions made by the learned Senior counsel for the Board, the learned counsel for the petitioner agrees for filing a fresh representation before the President of the Board.
