Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Masaudhi P.S. Case No. 361 of 2019 dated 14.05.2019 registered for the offence punishable under Section 302 of the Indian Penal Code. 3.
The main submissions advanced by learned counsel for petitioner are that the petitioner has no criminal antecedent, his trial has started and the charge upon him was framed on 07.09.2019 and thereafter several dates have been given by the trial Court to the prosecution to produce prosecution witnesses but till date no prosecution witness has been produced and examined and the petitioner has been languishing in jail for about four years and he himself surrendered before the Court concerned and the time of death of the deceased as mentioned in
Patna High Court CR. MISC. No.9856 of 2023(2) dt.04-05-2023 2/2 the post-mortem report is not corroborating to the time as disclosed in the FIR.

Learned APP for the State has opposed the bail prayer of the petitioner.

Considering the above submissions and mainly the petitioner's long judicial custody and prosecution's lingering attitude in concluding the petitioner's trial and also the facts that the petitioner has fair and clean antecedent and he himself surrendered before the Court below, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Masaudhi P.S. Case No. 361 of 2019.
