The petitioner prays for Anticipatory bail in Chapra Muffasil P.S. Case No. 38 of 2016, registered under Sections 147, 148, 149, 341, 342, 353, 323, 307, 504, 386, 379 and 120(B) of the Indian Penal Code.
It is submitted that the allegation of obstructing in discharge of duty or causing injury to the Police has not been alleged against the petitioner. The petitioner, being the Headmistress of the school has been named on a suspicion that the accuseds persons might have been arranged by her. Considering the above, I am persuaded to extend him the privilege of anticipatory bail in the event of arrest or surrender in the Court below within four weeks, the petitioner above named, is directed
Patna High Court Cr.Misc. No.35568 of 2016 (4) dt.29-11-2016 2/2 to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, saran at Chapra in connection with Chapra Muffasil P.S. Case No. 38 of 2016 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions:
(i) One of the bailers shall be the own/close family members of the petitioner.
(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure her arrest in accordance with law.
