The petitioner is accused in connection with Jagdishpur P.S. Case No. 241 of 2019, registered under Sections 307, 379 and other allied Sections of the Indian Penal Code. The accusation is that while Pankaj Tanti, brother of informant, Sintu Tanti, was in the way of Kola Gaon then six persons named in the FIR including the petitioner surrounded to him due to old enmity and all started to cause assault to him. At that time, Mithun Tanti (petitioner) gave khanti blow at the head of his brother, Pankaj Tanti. On raising alarm, when the informant reached there to save then he was also assaulted by them.

No.9480 of 2020(2) dt.25-02-2020 2/2 Learned counsel for the petitioner submits that due to some dispute, occurrence took place, in which, petitioner's side also sustained injury, regarding which, Jagdishpur P.S. Case No. 242 of 2019 is also instituted. The head injury, as found on the person of brother of the informant, is said to be caused by the petitioner is grievous in nature. Further submission is that petitioner is in custody since 16.11.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Jagdishpur P.S. Case No. 241 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
