2. The petitioner is in judicial custody in connection with Maniyari P.S. Case No. 16 of 2021 for the offence punishable under Sections 341, 323, 498(A), 304(B) of the Indian Penal Code and Section 3, 4 of D.P. Act lodged on 14.1.2021 by the informant, Chandeshwar Ram.

3. Earlier the petitioner had moved this Court for grant of bail in Cr. Misc. No. 29416 of 2023 which was rejected vide an order dated 18.8.2023.

4. As per the prosecution story, the lady was married to the petitioner's brother but was tortured for dowry and on the fateful day, she was assaulted and set ablaze. She was left at the place to die. However, it was the police which came and took

Patna High Court CR. MISC. No.8559 of 2024(3) dt.10-04-2024 2/3 her to Sri Krishna Medical College and Hospital, Muzaffarpur where she succumbed to the burn injuries.

Learned counsel submits that though there is allegation against him of setting the lady ablaze, the same allegation is against the mother-in-law and father-in-law who have since been extended the relief by a coordinate bench in Cr. Misc. No. 61286 of 2021 and Cr. Misc. No. 73945 of 2022, this Court has no option to follow the suit.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned 8th Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial No. 101 of 2022 arising out of Maniyari P.S. Case No. 16 of 2021 subject to the following conditions:

(i) one of the bailor should be the family member of the petitioner who shall provide official document to show his bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall appear before the concerned

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
