The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 337, 338, 332, 333, 427, 436 & 504 of the Indian Penal Code.

Petitioner along with other several co-accused are said to have involved in rioting, assaulting villagers of other village, setting fire to the shops, assaulting police personnel and obstructing them in discharge of their official duties. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case at the instance of village chaukidar due to previous enmity. The allegation levelled against the petitioner is not specific rather general and

It is further submitted that the petitioner was only the member of mob and no specific overt act of any kind has been attributed against him. It is further submitted that several similarly situated co-accused have been enlarged on bail by this court vide order dated 17.03.2023 and 18.04.2023 passed in Cr. Misc. No. 3436 of 2023 and Cr. Misc. No.9010 of 2023. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Barhara @ Barahara @ Brahara P.S. Case No. 514 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
