Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Raghunathpur PS case no. 61 of 2024 dated 22.06.2024 instituted for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The prosecution case, as per the First Information Report, is that upon secret information, the informant along with police party reached at the rented house of the petitioner and recovered 180 liters of foreign liquor. Accordingly, the seizure list was prepared.

Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely been implicated in this case due to village politics. Learned counsel further submits

Patna High Court CR. MISC. No.7214 of 2025(3) dt.19-03-2025 2/2 that the liquor has not been recovered from the conscious possession of the petitioner and/ or premises belonging to him. The petitioner is languishing in custody since 28.11.2024. 5.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is in custody since 28.11.2024 and charge-sheet has been filed, I am inclined to grant the privilege of bail to the petitioner.

This application is, accordingly, allowed.

Let the abovenamed petitioner be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned court of Exclusive Special Excise Court No.-I, East Champaran, Motihari in connection with Raghunathpur PS case no. 61 of 2024.
