JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the First Information Report but according to informant itself, the informant has not seen the actual killing of the deceased and informant claimed only to the extent that he had seen petitioner and some others fleeing from the place of occurrence.
It is admitted case of the prosecution that in course of investigation, the statement of informant was recorded under Section 164 of the Cr.P.C., in which, he exonerated some coaccused persons, making this statement that co-accused namely, Bhola Sah, Ritesh Sah and Sunil Ram had not participated in this occurrence.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.40102 of 2015 (5) dt.14-12-2015 2/2 the case as well as submission of the parties, let petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ander Police Station Case No. 13 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Siwan.
