2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. The first information report and the seizure list would go to show that there is a recovery of 100 liters of country made liquor from a motor-cycle.

4. Learned counsel for the petitioner submits that the name of the petitioner has surfaced in this case as he was the owner of the said motor-cycle. However, it has been submitted that the said vehicle had been sold to one Anil Yadav on 27.06.2017 itself and the petitioner has no concern either with the motor-cycle or with the seized liquor. On the last occasion, criminal antecedent report had also been called for and the same

Patna High Court CR. MISC. No.6295 of 2025(4) dt.18-06-2025 2/2 shows that the petitioner has no criminal antecedent.

5. Learned APP for the State opposes for prayer for bail.

6. In view of the aforesaid facts of the case, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Fatehpur P.S. Case No.528 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.4, Gaya, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
