JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One loaded country made pistol and one live cartridge are said to have been recovered from conscious possession of the petitioner and it appears that prior to institution of the present case, one case of Arms Act and one case of loot had been registered against the petitioner.

The contention on behalf of the petitioner is that the seizure list has not been signed by the independent witnesses and the aforesaid circumstance creates doubt about the genuineness of the prosecution story.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.41232 of 2015 (2) dt.14-09-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Balia P.S. Case No. 106 of 2015.
