The petitioners apprehend their arrest in Suryapura P.S. case No. 96 of 2018 registered under Section 307, 379, 354(B) and some other Sections of the Indian Penal Code. The informant alleged that some altercation took place for drainage. On such, the petitioners, Bharat Yadav and Ram Ayodhya Yadav, brutally assaulted the husband of informant on his head. The accused persons also assaulted the informant, Manorma Devi, Shekhar, Dharmendra on their head. The learned counsel for the petitioners submits that there is counter version. The injury found on the person of informant, her husband and others are simple in nature but from perusal of injury report of Bipin Bihari, husband of informant,
Patna High Court Cr.Misc. No.7760 of 2019(2) dt.11-02-2019 2/2 informant, Shekhar and Dharmendra it appears that they got head injuries. As many as four injuries are found on the head of Bipin Bihari. The petitioners indiscriminately assaulted the informant and her husband on vital parts of their body on account of petty dispute.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
