The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code. As per the prosecution case, FIR named accused persons with the help of some unknown persons killed the informant's husband.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR rather he is named as a witness therein and on protest petition filed by one of the culprits/witnesses, petitioner's name has come in the case. During investigation it has also come that the as the petitioner

Patna High Court CR. MISC. No.7081 of 2022(2) dt.07-04-2022 2/2 was the witness in two sale deeds, he has been roped in the instant case. Petitioner has claimed clean antecedent and he is in custody since 7.9.2021.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II Saharsa in Mashishi Police Station Case No. 138 of 2021.
