JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner and Mr. Gauri Shankar Gupta learned A.P.P. for the State. The petitioner seeks bail in connection with Excise Case No. 15 of 2022 instituted for the offences under Section 30 (a) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 09.01.2022 is a person with clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 149 liters of liquor from an Auto. Learned counsel for the petitioner submits that the petitioner is a driver and as such was not knowing who had kept the liquor in the Auto.

Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.7345 of 2022(2) dt.09-03-2022 2/2 prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 09.01.2022 is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, Aurangabad in connection with Excise Case No. 15 of 2022.
