JUSTICE MADHURESH PRASAD ORAL ORDER 08-07-2020 Since as of now the Courts have not resumed normal physical hearing, the matter has been listed today for consideration through video conferencing.

The learned counsels are appearing and making submissions from their residence. The Court Master and Secretary are also part of this virtual Court proceedings from their homes, all with the aid of audio visual technology. Heard learned counsel for the petitioners and the learned APP for the State.

The petitioners are apprehending their arrest in connection with Warisnagar P.S. Case No.234 of 2019 registered

Patna High Court CR. MISC. No.7598 of 2020(2) dt.08-07-2020 2/3 for the offence punishable under Sections 363 and 366 of the Indian Penal Code, which is pending in the court of the learned Additional Chief Judicial Magistrate, Samastipur. The informant has alleged that his daughter was married with Shivam Kumar, son of Petitioner Nos.1 and 3, on 31.10.2018. There is allegation that Petitioner Nos.1 and 3 along with their son have been demanding a motorcycle and subjecting the informant's daughter to torture, not allowing her to meet her parents and that on 29.08.2019 when the informant along with his brother went to meet his daughter, they were not allowed to meet, by the petitioners. It is further alleged that on 30.08.2019, the informant came to know that the petitioners had killed his daughter and concealed her dead body.

Petitioners' counsel submits that it is a false case. In fact, the victim and son of Petitioner Nos.1 and 3 had solemnized a love marriage. The story regarding demand of motorcycle is palpably false. Brother-in-law of the informant Shyam Nandan Singh, with whom the petitioners are on litigating terms, has conspired to implicate the petitioners. Learned APP for the State has opposed the prayer for pre-arrest bail.

Patna High Court CR. MISC. No.7598 of 2020(2) dt.08-07-2020 3/3 place where she was forcibly kept in confinement for more than one month. To this extent, the victim herself has given her statement under Section 164 Cr.P.C.

Considering the rival submissions and the gravity of the allegations, this Court does not find it to be a fit case for grant of anticipatory bail. It is, accordingly, rejected. (Madhuresh Prasad, J) PNM U T
